Hiking and backpacking are fun, challenging, and can be dangerous. Due to the nature of these outdoor and unpredictable activities, it is up to the participant to recognize and appreciate that dangers and hazards exist in the Maine woods and use their best judgement to participate in the hike and while they are on the trail.
By participating in the guided hike, the participant must accept and assume full responsibility for all harm and injury, of every nature, including death, and for all damages or loss to any personal property owned by themselves or damaged by them.
The participant must agree to indemnify, hold harmless and release Happy Trails Guide Service, and Stephen Hardy, from and against any and all claims, demands, actions or causes of action, on account of damage or loss to their personal property, their personal injury or death, or the personal injury, death or damage to personal property of others caused by themself, which may occur or result directly or indirectly from their participation in the guided hike and not as a direct result of any gross negligent act of Happy Trails Guide Service, or Stephen Hardy.

By joining a hike, you the participant are claiming that you are able to physically perform all tasks needed while on the hike with or without reasonable accommodation. If accommodation is needed, you may contact Happy Trails Guide Service or Stephen Hardy to arrange such accommodation.

All participants must sign this "Release and Assumption of Risk" and shall be construed and interpreted pursuant to the laws of the State of Maine, and if any portion thereof is held invalid, void, unenforceable or illegal, the remainder shall continue in full force and effect.
Participants under the age of 18: the parent/guardian must agree, in consideration of their child being permitted to participate in the guided hike, to be bound by the terms of this Release and Assumption of Risk and thereby indemnify, hold harmless and release Happy Trails Guide Service, or Stephen Hardy, in the same manner and with the same force and effect as set forth in the above written with regard to their child participating in the Program.
Dangers, hazards and risks of this activity may include, but are not limited to, injuries inflicted by the following:

Slips, trips, and falls that may cause bodily injury due to walking on uneven and/or steep terrain, wet or slippery surfaces.

Insect, spiders, and/or snake bites, as well as any induced allergic reactions from such bites as well as animal encounters and bites.

Weather-related afflictions due to exposure to natural elements (ex. Dehydration, hypothermia, sun burn, etc.)

Allergic reactions, including anaphylaxis, caused from food provided and/ or foraged during the guided hike.
Cancellations and Refunds
Cancellations more than 30 days prior to the trip will be refunded 100%. (minus credit card fees)
Cancellations less than 30 days prior to the trip, no shows, or non-completion of trip: no refund will be issued, and monies cannot be used for a future hike.
We work hard to fill our hikes and we do not overbook. Cancelled spaces are difficult to fill at the last minute.
In the event of an emergency or any other circumstance that would require ending a trip early, Happy Trails Guide Service may offer to reschedule your trip at a reduced rate, per their discretion.
If hike is cancelled by Happy Trails Guide Service, the client can choose to be refunded 100% or roll over fees to another trip date.
This policy stands for last-minute bookings.
